1. Acceptance of Terms

By downloading, installing, or using the SideStacks mobile application (the “App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.

SideStacks is operated by SideStacks, based in Australia (“we”, “our”, or “us”). These Terms are governed by the laws of Australia.

2. Description of the App

SideStacks is a financial tracking tool designed for freelancers, sole traders, and small business owners. The App allows you to:

• Track income and expenses across multiple side hustles or businesses
• Create and manage invoices
• Log mileage for tax deduction purposes
• View estimated tax calculations, including GST and BAS summaries for Australian users
• Connect bank accounts to import transactions (via TrueLayer)
• Attach receipt photos to transactions
• Export financial data as CSV or PDF

3. Account Registration

To use SideStacks, you must create an account using a valid email address or Google Sign-In. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to provide accurate and complete information when creating your account, and to update your information if it changes.

4. Subscriptions and Payments

4.1 Free and Premium Tiers

SideStacks offers a free tier with limited functionality and a premium subscription (“SideStacks Pro”) that unlocks additional features including full transaction history, advanced analytics, and receipt attachments.

4.2 Billing

Subscriptions are billed through the Google Play Store (Android) or Apple App Store (iOS). Payment is charged to your app store account at the time of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

4.3 Refunds

Refund requests are handled by the respective app store in accordance with their refund policies. We do not process payments directly and cannot issue refunds outside of the app store process.

5. Acceptable Use

You agree to use SideStacks only for lawful purposes and in accordance with these Terms. You must not:

• Use the App for any fraudulent, illegal, or unauthorised purpose
• Attempt to reverse-engineer, decompile, or extract the source code of the App
• Interfere with or disrupt the integrity or performance of the App or its servers
• Attempt to gain unauthorised access to other users’ accounts or data
• Use automated tools, bots, or scripts to interact with the App
• Resell, redistribute, or sublicense access to the App

6. Financial Disclaimer

SideStacks is a record-keeping and estimation tool. It is not a substitute for professional financial, tax, or legal advice. Specifically:

• Tax estimates, GST calculations, BAS summaries, and mileage deductions are approximations based on data you enter and standard published rates. They may not reflect your actual tax obligations.
• You are solely responsible for verifying all financial information and for meeting your tax filing obligations.
• We strongly recommend consulting a qualified accountant or tax professional for tax advice.
• SideStacks does not provide investment advice, financial planning, or accounting services.

We are not liable for any financial loss, tax penalty, or adverse outcome resulting from reliance on information provided by the App.

7. Bank Connectivity

SideStacks offers optional bank account connectivity through TrueLayer, a regulated Open Banking provider. By connecting a bank account, you:

• Authorise TrueLayer to access your bank transaction data on your behalf
• Acknowledge that your bank login credentials are handled entirely by TrueLayer and are never seen or stored by SideStacks
• Understand that bank access tokens are stored securely on our servers and can be revoked at any time by disconnecting within the App

We are not responsible for the availability, accuracy, or completeness of data provided by your bank through TrueLayer.

8. Intellectual Property

All content, design, code, logos, and trademarks in SideStacks are the property of SideStacks and are protected by Australian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal or business record-keeping purposes.

Any data you enter into the App remains your property. We do not claim ownership of your financial records, invoices, or other content.

9. Data and Privacy

Your use of SideStacks is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the data practices described in the Privacy Policy.

10. Service Availability

We strive to keep SideStacks available and functional, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any feature of the App at any time. In the event of a permanent discontinuation, we will make reasonable efforts to allow you to export your data.

11. Limitation of Liability

To the maximum extent permitted by Australian law:

• The App is provided “as is” and “as available” without warranties of any kind.
• We do not warrant that the App will be error-free, secure, or available at all times.
• Our total liability to you shall not exceed the amount you have paid us in subscription fees in the 12 months preceding the claim.
• We are not liable for any indirect, incidental, special, or consequential damages.

Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

12. Termination

You may stop using SideStacks at any time by deleting your account within the App or by uninstalling it. Active subscriptions must be cancelled through the relevant app store.

We reserve the right to suspend or terminate your account if you violate these Terms or misuse the App.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or via email. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of Australia. Any disputes arising from or relating to these Terms shall be resolved in the courts of Australia.
